The purpose of this privacy policy (the “Policy”) is to formalize our commitment to respecting the privacy of users of the website https://www.punch-croisieres.com/ (the “Site”) and customers of the company Punch Croisières.

As part of our boat rental activity (catamarans and monohulls), we process your personal data in compliance with the General Data Protection Regulation 2016/679 of April 27, 2016 (“GDPR”) and the French Data Protection Act.

Article 2: The Data Controller

Personal data is collected and processed by: Punch Croisières, a SAS with a capital of €45,000, whose registered office is located at Port de plaisance – Boulevard Allègre 97290 – Le Marin FWI, registered with the Fort-de-France RCS under number 400 083 713 00026.

Article 3: Data Collected and Purposes

We ensure that we only collect data that is strictly necessary for the purposes for which it is processed.

3.1 During simple navigation on the Site:

  • Data collected: IP address, connection and navigation data, display preferences.
  • Purpose: To ensure the proper functioning of the Site, to compile traffic statistics, and to improve ergonomics.

3.2 During a contact or quote request:

  • Data collected: Last name, first name, email address, telephone number, content of your message.
  • Purpose: To respond to your requests for information and to offer you deals adapted to your sailing projects.

3.3 When booking a boat (via Mister Booking):

  • Data collected: Identity (Last name, first name, date of birth), contact details (postal address, email, telephone), payment data (via our secure payment provider), booking details (dates, type of boat), and potentially your nautical CV / boat license (to prove your skills as a skipper).
  • Purpose: Execution of the boat rental contract, billing management, payment processing, and customer file follow-up.

Article 4: Sharing Data with Third Parties

Your personal data is never sold to third parties. It may, however, be shared with our trusted partners who act as subcontractors on our behalf:

  • Mister Booking: Our technological provider for the online booking system (Channel Manager / PMS). Mister Booking processes your identification and booking data to allow us to manage the fleet, schedules, and your rental contracts.
  • Payment providers: To secure bank transactions and credit card imprints (security deposits).
  • Competent authorities: Maritime affairs, customs, harbor master’s offices, port authorities, or sea rescue (CROSS, SNSM, etc.) (notably for the registration of crew lists if required by law, or in case of a request for assistance).

Article 5: Data Transfers Outside the European Union

As our clientele may be located in Martinique, mainland France, or internationally, we prioritize servers and providers located in the European Economic Area (EEA). If our providers (such as emailing tools) transfer data outside the European Union, we ensure that these transfers are governed by the European Commission’s Standard Contractual Clauses or any other adequate protection mechanism validated by the GDPR.

Article 6: Data Retention Period

  • Booking and billing data: Retained for 10 years to meet our legal accounting and tax obligations.
  • Prospect data (quote requests): Retained for 3 years from the last contact from the prospect.
  • Nautical CV / License data: Retained for the duration of the rental and the legal statute of limitations in the event of a dispute or maritime accident.

Article 7: Data Security

We have implemented technical and organizational security measures (SSL certificates, password-restricted access, GDPR-compliant providers like Mister Booking) to guarantee the integrity and confidentiality of your data and prevent any access by unauthorized third parties.

Article 8: Your Rights

In accordance with regulations (Articles 15 to 22 of the GDPR), you have the following rights regarding your data:

  • Right of access and rectification: To obtain a copy of your data and modify it.
  • Right to erasure (“right to be forgotten”): To request the deletion of your data, within the limits of our legal obligations.
  • Right to restriction and objection: To refuse certain processing of your data (e.g., newsletter).
  • Right to portability: To retrieve the data you have provided to us.
